General Terms: These terms and conditions will apply to all transactions placed online, by e-mail, telephone or by post with the Peak UK Kayaking Co Ltd. Please read carefully before placing any order. All contracts shall be governed by and construed in accordance with English Law and any dispute between us will be resolved exclusively in the courts of England and Wales. Nothing in these terms and conditions will be deemed to affect your statutory rights. By using this site you are agreeing to these terms and conditions. All transactions with the Peak UK Kayaking Co Ltd will be governed by these terms and conditions. All references to the 'company', 'us' or 'we' will refer to the Peak UK Kayaking Co Ltd. All references to the customer shall mean the person or persons purchasing or agreeing to purchase goods from the company.

Prices: All prices are shown in pounds sterling (£) or Euros (€). All prices are subject to change without prior notice.

Orders: We are pleased to accept orders by any of the following methods. Online transaction (secure server), e-mail (unsecure), telephone or post. All credit / debit card transactions are subject to validation checks and are authorized by the card issuer. We accept MasterCard, Visa, Switch, JCB and Solo. If the issuer of your card refuses to authorize payment to us, we will not be liable for any delay and / or non-delivery of your order. No orders will be accepted or processed without a valid card payment in the name of the registered cardholder.

Delivery: All UK orders over £50 are sent free of charge. UK orders under £50 incur a £5 postage fee. All Ireland orders over €100 are sent free of charge. Ireland orders under €100 incur a €10 postage fee. EU countries (exc. Ireland) incur €20 postage fee. Rest of the World incurs a £30 postage fee. Items ordered will be delivered as soon as possible. Every effort is made to ensure that delivery is made within a maximum of thirty days. All goods are subject to availability. In the event that we are unable to supply your goods within thirty days, we will inform you immediately and advise you of the expected delivery date. The exception is with custom and bespoke items which may take longer. Please contact us for lead times. Outstanding orders / items can be cancelled at any time and a full refund given. In the event of any goods delivered by us being damaged in transit, deficient of items shown on the delivery note or failing to match the items ordered by you, then such details must be notified by you to us within seven working days of receipt. If we receive no such notification the customer will be deemed to have accepted the items as satisfactory. We cannot be held liable for any consequential loss caused by late delivery or failure to deliver by the company's appointed carrier. Liability in such cases is limited to the value of those items, which are shown to have not been received by the customer.

Returns and Exchanges: (Please see the Returns Page for more details.) We hope that you are entirely satisfied with every purchase made from the Peak UK Kayaking Co Ltd and strive to offer you excellent quality, value and service at all times. If you wish to return an item for exchange or you have decided not to keep it, please return to us within 14 days of purchase. We will exchange or refund the cost of the item(s) where appropriate. Specially made items such as Topdecks, Custom items and Polo Vests may be non refundable unless faulty. All goods must be in a new and unused condition together with a copy of your original receipt where possible. If you wish to return any item due to it being faulty, again please contact us by email or telephone giving details of the fault and then send it back to us together with the item in its original packaging, where possible, and your receipt. We will exchange the item or refund the full value. We recommend that all items returned to us be sent recorded delivery.

The cost of returning items to Peak UK or Peak EU must be covered by the customer unless the goods were sent in error, or arrived in a faulty condition. Peak UK will only refund the postage charges for goods sent in error or for faulty goods that are not used. The goods should be returned by UK post first class recorded delivery. The maximum refund given for postage fees is £10. All faulty or sent in error returns must be authorized in advance. To arrange a return please call Peak UK on 01629 732611. If you have a European or Rest of the World order that was sent in error, or arrived in a faulty condition please contact us immediately. 

Products: Products are sold singularly unless otherwise stated. Every effort is made to ensure the colours depicted on the site match as closely as possible those of the actual product. Due to technical limitations, some colours may vary.

Warranty: (Please see the Warranty page for more details). Unless otherwise clearly stated, Peak PS garments are designed and guaranteed for performance canoe and kayaking only. Under normal use, Peak PS products are guaranteed for one year from the date of purchase against faults in manufacture and materials. Your customers receipt is the guarantee. Make sure you keep your receipt and keep details of the sale. Although Peak PS garments are made from top quality materials, using the best construction techniques available, they are not covered against excessive wear and tear, misuse, and over use. 

Peak PS garments will not keep users 100% dry. Some water may enter via the garment’s seals and openings. Condensation can build up inside garments even though its fabric is breathable. Breathability will help reduce condensation, but will not eliminate it, especially in damp and humid conditions. Due to the fragile nature of the materials used, breakage of zips, latex seals, neoprene seals and fabric socks are not covered by warranty. They can be replaced for a reasonable fee. If any item is modified by the customer, its warranty is invalid.

In the unlikely event of any problems, please return the item to Peak UK with a copy of your receipt and a completed Returns Form detailing the problem you are experiencing. 

Customers are responsible for the shipping costs of goods returned to Peak UK for warranty or repair. The return cost to the customer will be covered by Peak UK only if the item is a valid warranty issue. Returns must be agreed in advance. Peak UK will endeavor to repair garments where possible. If the item is not repairable, a replacement or alternative will be offered. Where a replacement is not available, an account credit will be issued. Due to the nature of seam sealing adhesion on used and dirty fabric, repairs are not warrantied.

Custom Gear: Custom items can take up to sixteen weeks to produce as these special items are manufactured individually to order. Bespoke artwork for custom orders must be approved by the customer before production can begin. It is the customers responsibility to make sure that any logos and images used have the permission of use from the copyright owner. Peak UK reserve the right to refuse to print inappropriate or poor quality artwork. Peak UK cannot guarantee perfect colour matching of fabric, printing or trim of any garments supplied or of previously produced custom equipment. Some variation in colour may occur from order to order and between screen PDF proofs and the actual printed garment. Peak UK print using a four-colour process (CMYK). If Pantone colour references are supplied, Peak UK will match these references to the CMYK equivalent. It is preferred that colours specifications are supplied with CMYK values. Peak UK reserve the right to reproduce any custom printed artwork for the purposes of event display / promotion without the prior expressed permission of the customer. Custom orders that have had their order status altered to ‘processing’ can not be changed or cancelled. When delivered, custom made items may be non refundable unless faulty, please contact us immediately to discuss and confirmed. 

Pricing and Print Errors: Prices and specifications are checked to the best of our ability, and whilst every effort has been made to make them accurate, no responsibility will be accepted for errors and omissions. We reserve the right to alter our prices and specifications without notice.

Ownership of Goods: All items supplied to the customer remain the property of the Peak UK Kayaking Co Ltd until final payment of all sums owing in respect of those goods has been received in full by us.

Security: We are fully committed to providing full security both through our on-line and mail order service. We use secure socket layer (SSL) technology to ensure that your details are safe for all sales transactions with us. All information you provide is fully encrypted so that it cannot be read by third parties.

Risk: Canoeing, kayaking and other watersports are high risk activities. Peak UK items do not guarantee rescue or survival. Users need the appropriate skill and training before heading out on the water. Peak PS one piece suits, jackets and pants are not survival or submersion suits. They are high performance items of paddling apparel.
